Miller alleged that the parties had an oral contract for the work, while Stresstek maintained that it was not bound because it had not signed a written contract. The district court held that a written contract, although contemplated by the parties, was a mere formality and that Stresstek was bound by an oral contract to do the work. Stresstek appealed. We affirm and award Miller attorney fees on appeal.
